1. The Data Controller of www.themomentum.ai website, hereinafter referred to as the Service is Momentum Sp. z o.o. with its seat in Wrocław, ul. Gen. Władysława Sikorskiego 26, 53-659 Wrocław, KRS: 0000602983, NIP: 8992778355, REGON: 3363012720.
2. The Data Controller undertakes to safeguard and to keep confidential any data obtained from you, with respect to your rights as the data subjects (i.e. the persons to whom the data relate) and with regard to the applicable laws, in particular Regulation (EU) 2016/679 of The European Parliament and of The Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC General Data Protection Regulation („GDPR”), the Act of 10th of May 2018 on personal data protection („Act") and any other applicable laws on personal data protection.
3. All the Data Controller's employees with the access to the personal data have been properly trained on processing the personal data. Moreover, the Data Controller has implemented appropriate safeguards, technical and organizational protection measures in order to ensure the highest level of protection, as well as procedures and policies of personal data protection compliant with GDPR, by which the Data Controller ensures lawful and fair processing, as well as enforceability of all your rights as the persons to whom the data relate. In addition, if necessary – in cases provided for by the acts- the Data Controller cooperates with or consult the supervisory authority in the territory of the Republic of Poland, i.e. the Chairman of the Personal Data Protection Office (hereinafter referred to as the GDPR

5. Data Controller collects the following personal data: a. name, surname and the name of the company – in order to use the Service you will be asked to share your name, surname and the name of the company, so as to make contact with you possible, to present you with our offer and to provide you with the services,
b. e-mail address and phone number – sharing your phone number will allow us to contact you primarily in case of sudden and unforeseen situations, when it is possible to simultaneously offer and arrange the best solution,
c. NIP – Tax Identification Number is necessary to issue an invoice
accordance with applicable laws,
d. IP address of the device – information stemming from the general rules of connections being established in the Internet, such as IP address (and any other information included in the system logs), used by the Data Controller for technical purposes.
6. Sharing the data referred to in the precedent section is necessary in following cases: a. to make a contact using the contact form available on the Service,
b. to prepare – at your request- the offer before concluding the agreement,
c. to conclude the agreement and to use services available on the Service.
7. The Data Controller processes personal data for the shortest time possible. For specific cases, the data processing duration is as follows: a. Personal data based on a contract - the processing shall continue for as long as the contract is in effect and for the duration of the limitation period for any potential claims.
b. Based on consent for processing for a specific purpose - processing of personal data lasts until you withdraw your consent.
c. Data processed in the pursuit of our legitimate interests - for as long as that interest persists.
d. Data processed for the purpose of fulfilling our obligations under applicable legal regulations - for as long as required by those regulations.
8. Our Service uses Cookie technology in order to adjust the way it functions to your individual needs. As a result, you may agree to have your data and information remembered, so it will be possible to use them when you next visit the Service, without the need to re-enter them. The owners of the other websites shall have no access to said data and information. 9. The source of personal data processed by the Data Controller are the persons to whom such data relate and you as the Data Controller’s Clients (recipient of the Services)
10. Your personal data are not transferred to the third country in the meaning of GDPR provisions.
11. The Data Controller does not disclose your personal data to the third parties without your explicit consent (i.e. the consent of the person to whom the data relate). Disclosing such data without the consent of the abovementioned person is possible only to the public authorities, public administrative bodies (tax offices, law enforcement authorities and other authorities, having legitimacy given by the applicable laws).
12. Processing of personal data can be entrusted to the subjects processing such data on behalf of the Data Controller. In such a case the Data Controller enters into a processing agreement. The processor processes the entrusted personal data but only for the needs, to the extent and for the
purposes defined in the processing agreement referred to in the preceding sentence.

15. In relation to the right to erase your personal data (right to be forgotten), subject to letter d) of the precedent section, the Data Controller indicates that according to GDPR you cannot exercise this right if: a. processing of your personal data is necessary to exercise the right to the freedom of speech and information (for example if you publish your data on the blog or in the comments),
b. processing your personal data is necessary for the Data Controller to fulfill his legal obligations – the Data Controller cannot erase your data for the time necessary to fulfill his obligations (for example taxes), imposed by applicable laws,
c. your data is processed for exercise or defence of legal claim
16. Any case of infringing the safety is recorded and if any of the events described in GDPR or in Act occur, the persons to whom the data relate are informed, as well as PUODO – if applicable.
17. In all the matters not covered by this Privacy Policy, proper provisions of law apply. In case of any discrepancy between this Privacy Policy and said provisions, such provisions shall prevail.
18. The Data Controller reserves the right to unilaterally amend the content of this Privacy Policy at any time. The changes shall take effect as of the date of their publication on the website www.themomentum.ai

1. Administratorem danych osobowych w ramach strony internetowej www.the momentum.ai, zwanego dalej Usługą, jest Momentum Sp. z o.o. z siedzibą we Wrocławiu, ul. Gen. Władysława Sikorskiego 26, 53-659 Wrocław, KRS: 0000602983, NIP: 8992778355, REGON: 3363012720.
2. Administrator Danych zobowiązuje się do ochrony i zachowania poufności wszelkich danych uzyskanych od Państwa, z poszanowaniem Państwa praw jako podmiotów danych (tj. osób, których dane dotyczą) oraz z uwzględnieniem obowiązujących przepisów prawa, w szczególności Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fi zycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE ogólne rozporządzenie o ochronie danych („RODO”), ustawy z dnia 10 maja 2018 r. o ochronie danych osobowych („Ustawa”) oraz wszelkich innych obowiązujących przepisów prawa dotyczących ochrony danych osobowych.
3. Wszyscy pracownicy Administratora Danych mający dostęp do danych osobowych zostali odpowiednio przeszkoleni w zakresie przetwarzania danych osobowych. Ponadto Administrator Danych wdrożył odpowiednie zabezpieczenia, środki ochrony technicznej i organizacyjnej w celu zapewnienia najwyższego poziomu ochrony, a także procedury i polityki ochrony danych osobowych zgodnie z RODO, dzięki którym Administrator Danych zapewnia zgodne z prawem i rzetelność przetwarzania, a także egzekwowalność wszystkich praw przysługujących Państwu jako osobom, których dane dotyczą. Ponadto, w razie konieczności – w przypadkach przewidzianych w ustawach – Administrator Danych współpracuje lub konsultuje się z organem nadzorczym na terytorium Rzeczypospolitej Polskiej, tj. 5. Administrator Danych zbiera następujące dane osobowe:
a. imię, nazwisko i nazwa fi rmy – w celu korzystania z Usługi zostaniesz poproszony o podanie imienia, nazwiska i nazwy fi rmy, w celu umożliwienia nawiązania z Państwem kontaktu, przedstawienia Państwu naszej oferty oraz świadczenia Państwu usług,
b. adres e-mail i numer telefonu – podanie numeru telefonu umożliwi nam kontakt z Tobą przede wszystkim w przypadku nagłych i nieprzewidzianych sytuacji, kiedy możliwe będzie jednoczesne zaproponowanie i ustalenie najlepszego rozwiązania,
c. NIP – Numer Identyfi kacji Podatkowej jest niezbędny do wystawienia faktury zgodnie z obowiązującymi przepisami,
d. Adres IP urządzenia – informacja wynikająca z ogólnych zasad połączeń realizowanych w Internecie, taka jak adres IP (oraz wszelkie inne informacje zawarte w logach systemowych), wykorzystywana przez Administratora Danych w celach technicznych.
6. Udostępnianie danych, o których mowa w punkcie poprzedzającym, jest konieczne w następujących przypadkach:
a. nawiązania kontaktu za pomocą formularza kontaktowego dostępnego w Usłudze,
b. przygotować – na Państwa życzenie – ofertę przed zawarciem umowy,
c. zawarcia umowy i korzystania z usług udostępnianych w ramach Usługi.
7. Administrator Danych przetwarza dane osobowe przez możliwie najkrótszy czas. W poszczególnych przypadkach czas przetwarzania danych jest następujący:
a. Dane osobowe oparte na umowie – przetwarzanie będzie trwało tak długo, jak długo będzie obowiązywała umowa i przez okres przedawnienia ewentualnych roszczeń.
b. Na podstawie zgody na przetwarzanie w określonym celu - przetwarzanie danych osobowych trwa do momentu cofnięcia zgody.
c. Dane przetwarzane w celu realizacji naszych uzasadnionych interesów – tak długo, jak długo będzie istniał ten interes.
d. Dane przetwarzane są w celu wypełnienia obowiązków wynikających z obowiązujących przepisów prawa – tak długo, jak wymagają tego przepisy prawa.
8. Nasza Usługa korzysta z technologii Cookie, aby dostosować sposób jej działania do Twoich indywidualnych potrzeb. 11. Administrator Danych nie udostępnia Twoich danych osobowych osobom trzecim bez Twojej wyraźnej zgody (tj. zgody osoby, której dane dotyczą). Udostępnienie takich danych bez zgody ww. osoby jest możliwe wyłącznie organom władzy publicznej, organom administracji publicznej (urzędy skarbowe, organy ścigania i inne). władze, posiadające legitymację wynikającą z obowiązujących przepisów prawa).
12. Przetwarzanie danych osobowych może zostać powierzone podmiotom przetwarzającym takie dane w imieniu Administratora Danych. W takim przypadku Administrator Danych zawiera umowę powierzenia przetwarzania . Podmiot przetwarzający przetwarza powierzone dane osobowe, ale wyłącznie na potrzeby, w zakresie i w celach określonych w umowie powierzenia, o której mowa w zdaniu poprzednim .
13. Twoje dane nie będą podlegały zautomatyzowanemu podejmowaniu decyzji.
14. Według z RODO, jako osoby, których dane osobowe są przetwarzane w ramach Usługi, macie Państwo prawo do:
a. Jeśli chcesz uzyskać dostęp, sprawdzić poprawić, zaktualizować lub zażądać usunięcia swoich danych osobowych, możesz to zrobić w dowolnym momencie, kontaktując się z nami za pośrednictwem poczty elektronicznej pod adresem documents@themomentum.ai
b. Ponadto możesz sprzeciwić się przetwarzaniu Twoich danych osobowych, poprosić nas o ograniczenie przetwarzania Twoich danych osobowych lub zażądać przeniesienia Twoich danych osobowych. I tutaj możesz również skorzystać z tych praw, kontaktując się z nami pod adresem documents@themomentum.ai
c. Jeśli zebraliśmy i przetworzyliśmy Twoje dane osobowe za Twoją zgodą, możesz ją w każdej chwili wycofać. Wycofanie zgody nie wpłynie na zgodność z prawem przetwarzania, które miało miejsce przed wycofaniem, ani nie wpłynie na przetwarzanie Twoich danych osobowych na podstawie zgodnych z prawem podstaw przetwarzania innych niż zgoda.
d. Masz prawo wnieść skargę do organu nadzorczego zajmującego się ochroną danych osobowych, gdy uznasz, że przetwarzanie Twoich danych osobowych narusza przepisy prawa.
15. W odniesieniu do prawa do usunięcia danych osobowych (prawa do bycia zapomnianym), z zastrzeżeniem lit. d) punktu poprzedzającego, Administrator Danych wskazuje, że zgodnie z RODO nie możesz skorzystać z tego prawa, jeżeli:
a. przetwarzanie Twoich danych osobowych jest niezbędne do realizacji prawa do wolności słowa i informacji (np. jeżeli publikujesz swoje dane na blogu lub w komentarzach),
b. przetwarzanie Twoich danych osobowych jest niezbędne do wypełnienia obowiązku prawnego ciążącego na Administratorze – Administrator nie może usunąć Twoich danych przez czas niezbędny do wypełnienia obowiązku prawnego (np. podatkowego) nałożonego przez obowiązujące przepisy prawa,
c. Twoje dane są przetwarzane w celu dochodzenia lub obrony roszczeń prawnych
16. Każdy przypadek naruszenia bezpieczeństwa jest odnotowywany, a jeżeli wystąpi którekolwiek ze zdarzeń opisanych w RODO lub Ustawie,
informowane są osoby, których dane dotyczą, oraz PUODO – jeżeli ma to zastosowanie.
17. We wszystkich kwestiach nieobjętych niniejszą Polityką Prywatności stosuje się właściwe przepisy prawa. W przypadku jakichkolwiek rozbieżności pomiędzy niniejszą Polityką Prywatności a ww. przepisami, pierwszeństwo mają te przepisy.
